1. Who we are and scope

These Terms govern purchases made on soivane.com (the “Store”). The seller is Vasyl Ivanyš, sole trader, IČO 23221381, Nový Malín 39, 788 03 Nový Malín, Czech Republic, email soivane@email.cz (“we”, “us”). The Store is operated on the Shopify platform. These Terms apply to consumers and, where indicated, to business customers. The contract is concluded in English. Our Refund & Returns Policy, Shipping Policy and Privacy Policy form part of these Terms.

2. Products

Our products are cosmetic products made to order by our manufacturing partner in the EU and compliant with Regulation (EC) No 1223/2009. Product images are illustrative; colours of shades may appear slightly different depending on your screen. Please read the full ingredient list (INCI) on each product page before purchasing, especially if you have allergies or sensitive skin. Cosmetics are for external use only; we recommend a patch test before first use and discontinuing use if irritation occurs.

3. Prices and payment

All prices are in euros (EUR). The seller is not a VAT payer; prices are final. Shipping costs are shown at checkout before you place your order. We accept the payment methods displayed at checkout. Payment is due when you place your order. Obvious pricing errors (e.g. a price clearly far below the usual price due to a technical error) do not bind us; in such a case we will contact you and you may confirm the order at the correct price or cancel it with a full refund.

4. Orders and conclusion of the contract

Product presentation in the Store is an invitation to make an offer. By clicking the order button with an obligation to pay, you submit a binding order. We confirm receipt of your order by email; the contract is concluded when we send you this order confirmation. Before submitting your order you can review and correct all entered data. We store the contract text (order details and these Terms) and send it to you by email.

5. Delivery

We deliver to EU addresses only. Delivery times and costs are described in our Shipping Policy. Ownership of the goods passes to you upon full payment; risk passes on delivery to you.

6. Right of withdrawal

Consumers have a 14-day right of withdrawal, subject to the hygiene exception for sealed cosmetics that have been unsealed after delivery (Art. 16(e) Directive 2011/83/EU; § 1837(g) Czech Civil Code). Details, including the model withdrawal form and return costs, are set out in our Refund & Returns Policy.

7. Legal guarantee and complaints

You have the statutory rights for lack of conformity for 24 months from delivery. Complaints can be made by email to soivane@email.cz. We will confirm receipt of your complaint and resolve it without undue delay, at the latest within 30 days, unless we agree a longer period with you. Details are in our Refund & Returns Policy.

8. Liability

We are liable in accordance with applicable law. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or any liability that cannot be excluded under mandatory consumer law. We are not responsible for damage caused by use of products contrary to their instructions or intended use.

9. Accounts and acceptable use

You are responsible for keeping your account credentials confidential. You may not use the Store for unlawful purposes, attempt to disrupt it, or misuse its content.

10. Intellectual property

The Soivane name, logo, texts, images and design of the Store are protected and may not be used without our prior written permission.

11. Dispute resolution and governing law

These Terms are governed by Czech law. If you are a consumer residing in another EU country, you also benefit from the mandatory consumer protection provisions of the law of your country of residence (Art. 6 Rome I Regulation). Consumers may use out-of-court dispute resolution: the competent body is the Czech Trade Inspection Authority (ČOI), coi.gov.cz/informace-o-adr. Supervision of our trade is exercised by the competent Trade Licensing Office and by the ČOI.

12. Changes

We may amend these Terms for the future. The version in force at the time of your order applies to that order.
